Do You Actually Need a Solicitor?

Here is the part most people are never told: the majority of everyday legal problems do not actually need a solicitor. They need a qualified professional who understands what is going on, what your options are, and what to do next. That is a very different thing, and a much more affordable one.

What is a solicitor, exactly?

A solicitor is a regulated lawyer who is authorised by the Solicitors Regulation Authority (SRA) to undertake what UK law calls “reserved legal activities.” These are specific tasks that, by law, only certain professionals are allowed to do.

The reserved activities, set out in the Legal Services Act 2007, are:

  • Representation in court (a right of audience)
  • Conducting litigation
  • Reserved instrument activities (mostly property transfers and conveyancing)
  • Probate activities (handling parts of a deceased person’s estate)
  • Notarial activities
  • Administration of oaths

Anything that is not on that list is not a reserved activity. And here is the part that surprises a lot of people: the vast majority of legal questions that come up in everyday life and everyday business are not on that list.

The grey area where most legal problems actually live

When somebody tells us about their “legal problem,” about nine times out of ten, that problem looks like one of these:

  • A letter has arrived (from HMRC, the council, an employer, a landlord, a debt collector, a regulator, a customer) and they are not sure what it really means or how to respond
  • A contract has landed in their inbox and they want to understand what they are agreeing to before they sign
  • They need a contract drafted, but the law-firm quote was eye-watering
  • A dispute is brewing with a customer, a supplier, an employee, or a counterpart
  • A tax investigation, fine, or penalty has appeared, and they want to challenge it
  • They are setting up a business and want to make sure it is done properly
  • They want a second opinion before doing something with significant consequences

None of those problems require a solicitor. They require a knowledgeable person who can read the situation, explain it without making you feel small, and help you take the right action. In many cases, the matter can be fully resolved before it ever has to reach a courtroom.

When you genuinely do need a solicitor (or a barrister)

There are situations where you really do need a regulated solicitor or, in some cases, a barrister. The main ones:

  • Your matter is heading to court and someone needs to represent you formally
  • You are buying or selling a property, transferring land, or dealing with a complex probate matter
  • You are facing criminal proceedings
  • You need a document executed in a specific way that, by law, only a solicitor can handle

If you find yourself in one of those situations, you do need a regulated lawyer. The good news is that you usually do not need to spend the first three meetings working out whether you have a problem at all.
